Description of Service

POSVERSE provides a cloud-based point of sale system for restaurants, retail stores, and hospitality businesses. Our services include:

  • Inventory management
  • Staff management tools
  • Analytics and reporting
  • Customer support

    • We reserve the right to modify, suspend, or discontinue any part of our services at any time.

    Account Registration

    To use our services, you must:

  • Create an account with accurate information
  • Maintain the security of your account credentials
  • Be at least 18 years old
  • Have the legal authority to enter into this agreement

    • You're responsible for all activities that occur under your account. Notify us immediately if you suspect unauthorized access.

    Use of Service

    You agree to use our services only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Transmit harmful code or malware
  • Attempt to gain unauthorized access
  • Interfere with or disrupt the services
  • Use the service for any illegal or unauthorized purpose
  • Resell or redistribute our services without permission

    • Payment Terms

    Our services are provided on a subscription basis. Payment terms include:

  • Subscription fees are billed in advance (monthly or annually)
  • All fees are non-refundable except as required by law
  • We may change our pricing with 30 days' notice
  • Late payments may result in service suspension
  • You're responsible for all applicable taxes

    • Payment processing fees may apply for transactions processed through our system.

    Intellectual Property

    All content, features, and functionality of our services are owned by POSVERSE and protected by copyright, trademark, and other laws.

    You retain ownership of your data. By using our services, you grant us a license to use, store, and process your data as necessary to provide the services.

    You may not copy, modify, distribute, or create derivative works of our services without written permission.

    Data and Privacy

    We take data protection seriously. Your use of our services is also governed by our Privacy Policy.

    We will:

  • Process your data only as necessary to provide services
  • Implement appropriate security measures
  • Not sell your data to third parties
  • Comply with applicable data protection laws

    • You are responsible for ensuring you have the right to process any customer data you input into our system.

    Termination

    Either party may terminate this agreement:

  • You may cancel your subscription at any time
  • We may suspend or terminate accounts that violate these Terms
  • Upon termination, your access to services will end
  • We may delete your data after a reasonable retention period

    • Termination doesn't relieve you of obligations for fees incurred before termination.

    Disclaimers

    Our services are provided "as is" and "as available" without warranties of any kind, either express or implied.

    We don't guarantee that:

  • The services will be uninterrupted or error-free
  • All defects will be corrected
  • The services will meet your specific requirements

    • You use our services at your own risk.

    Limitation of Liability

    To the maximum extent permitted by law:

  • POSVERSE shall not be liable for indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid us in the 12 months before the claim
  • We're not responsible for losses due to factors outside our control

    • Some jurisdictions don't allow these limitations, so they may not apply to you.

    Indemnification

    You agree to indemnify and hold POSVERSE harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of our services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your data or content

    • We reserve the right to assume exclusive defense and control of any matter subject to indemnification.

    Modifications to Terms

    We may update these Terms from time to time. We'll notify you of significant changes by:

  • Email to your registered address
  • Notice through our platform
  • Updating the "Last Updated" date

    • Your continued use after changes means you accept the updated Terms. If you don't agree, you should stop using our services.

    Governing Law

    These Terms are governed by the laws of the jurisdiction where POSVERSE operates, without regard to conflict of law principles.

    Any disputes will be resolved through binding arbitration or in the courts of our jurisdiction, as applicable.
